Wills
Your will may be simple or more complex, depending on your circumstances and the circumstances of your family and/or dependents. We will take the time to understand your circumstances and advise on appropriate estate planning strategies and documentation.
Enduring Power of Attorney Documents
This document functions to appoint a trusted person/s to assist with the management of your legal and financial affairs whilst you are alive (but only under certain circumstances, such as medical incapacity).
Enduring Guardianship Documents
This document empowers a person/s to assist with medical, care, health and lifestyle decision-making for you if you are unable to make these decisions for yourself.
Superannuation Death Benefit Nominations
Often the most overlooked and undervalued part of any estate plan. Super funds are great at taking your money but not always quite so good at helping you understand who can and can’t receive your superannuation death benefits.
Estate Administration Services
Applications for a grant of probate (where a person dies with an effective will);
Application for a grant of administration (where a person dies without a will or “intestate”);
Other complex applications (for example, where there is a formality problem with a will or an urgent grant is required to administer assets);
Claims for superannuation death benefits; and
Property related transactions and transfers (conveyancing).
Contested Estate Negotiations and Litigation
Family provision (where a person has been inadequately provided for in a will);
Contested probate (where a will is challenged on the basis of incapacity or undue influence);
We will also assist to first explore and negotiate non-litigated outcomes so as to avoid the expense and uncertainty of legal proceedings.
